Help On Obtaining a Divorce Lawyer

By Article Expert on Jul. 4, 2009.

When going through a divorce, there are many different issues that have to be thought through.  There are many different documents to be processed and filings to be done as well as agreements to be sorted out before the divorce can be finalized.Although there are many forms that are free online for the person to use to obtain the divorce, it is generally intelligent to get a divorce lawyer to help with all of the dealings so that everything goes easily and nothing is ignored in the process.  Although a divorce lawyer can be expensive, it is usually worth it in the long run to be well advised and represented by someone who has had a lot of experience in the field rather than by trying to save money up front but finding that there are issues that were not considered throughout the proceedings, requiring the couple go back to court.

Fees Of A Divorce Lawyer

There is really no such thing as a cheap divorce lawyer.  Divorce lawyers cost what they are worth, and finding a cheap lawyer can end up being detrimental to the individual in the long run, and possibly more expensive if the lawyer does not know what he is doing and spends more time on the case than is reasonable.  There is not any way to predict what the divorce lawyer’s fees will be in total as each divorce case is different.  However, there are different ways that divorce lawyers charge their fees, so individuals can choose what way works best for them.

There are always written retainer agreements given to the individual by the divorce lawyer at the beginning of the legal relationship. This document figures out the legal fees that will be charged during the course of the divorce, therefore one must read through the document carefully and make sure that he understands what is in it.  There are some fees that the lawyer will charge in most cases that are flat fees.  This means that the divorce lawyer charges a set amount to file certain documents or certain motions during the divorce proceedings.  This helps the individual to plan on certain cost up front since there is certain paperwork and certain motions that must be done in all divorce proceedings.

If the divorce is contested, there will also be hourly fees that the divorce lawyer will charge for the negotiations that are done during the course of the divorce.  These hourly rates can vary from lawyer to lawyer, ranging from seventy-five dollars to two hundred fifty dollars per hour.  There are sometimes reduced rates if there is an associate attorney or paralegal that does some of the work, which can help the individual with cost.
